Bad Bunny Helps Defeat Copyright Claim That Threatened Thousands of Reggaeton Songs

Bad Bunny and dozens of other artists have scored a major victory in a copyright lawsuit targeting nearly 2,000 songs, after a federal judge reversed an earlier decision and rejected claims of ownership over the dembow rhythm, the boom-ch-boom-chick beat at the heart of reggaeton. In a ruling reported by Billboard, Judge André Birotte Jr. found that Jamaican producer Cleveland “Clevie” Browne and the heirs of Wycliffe “Steely” Johnson failed to establish copyright control over the rhythm. Their 2021 lawsuit targets more than 150 artists, including Karol G, Daddy Yankee, J Balvin, Drake, and Luis Fonsi. The decision marks a reversal from July, when Birotte ruled that a jury should determine whether the musical arrangement was protected by copyright. Bad Bunny’s attorneys subsequently asked him to reconsider, arguing that the plaintiffs were asserting a “Frankenstein” copyright assembled from elements of three separate songs.
